B's Design Jewelry terms and conditions

Applicability General Conditions

1 The General Terms and Conditions apply to all offers, agreements and deliveries of B's Design Juwelry, unless expressly agreed otherwise in writing.

2 If the Customer includes provisions or conditions in its order, confirmation or notification containing acceptance that deviate from or do not appear in the General Terms and Conditions, these are only binding on B's Design Juwelry if and insofar as they have been expressly accepted by B's Design Juwelry in writing.

3 In the event that specific product or service conditions also apply in addition to these General Terms and Conditions, those conditions also apply, but the Customer can always invoke the applicable provision that is most favorable to him in the event of conflicting conditions.

Prices and information

1 All prices stated on the Website and in other materials originating from B's Design Juwelry include VAT and other levies imposed by the government.

2 If shipping costs are charged, this will be clearly stated in good time before the Agreement is concluded. In addition, these costs will be shown separately in the ordering process.

3 The content of the Website has been compiled with the greatest care. However, B's Design Juwelry cannot guarantee that all information on the website is correct and complete at all times. All prices and other information on the Website and in other materials originating from B's Design Juwelry are therefore subject to obvious programming and typing errors.

4 B's Design Juwelry cannot be held responsible for (colour) deviations as a result of screen quality.

Conclusion of Agreement

1 The Agreement is concluded at the moment of acceptance by the Customer of the offer of B's Design Juwelry and the fulfilment of the conditions set by B's Design Juwelry.

2 If the Customer has accepted the offer electronically, B's Design Juwelry will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the Customer has the option to dissolve the Agreement.

3 If it appears that when accepting or otherwise entering into the Agreement, the Customer has provided incorrect information, B's Design Juwelry has the right to fulfill its obligation only after the correct information has been received.

4 B's Design Juwelry can inform itself within legal frameworks whether the Customer can meet its payment obligations, but also of all facts and factors that are important for a responsible conclusion of the Agreement. If B's Design Juwelry has good reasons not to enter into the Agreement on the basis of this investigation, it is entitled to refuse an order or request with reasons or to attach special conditions to the execution, such as advance payment.

Execution Agreement

1 As soon as the order has been received by B's Design Juwelry, B's Design Juwelry will send the products as soon as possible with due observance of the provisions of paragraph 3 of this Article.

2 B's Design Juwelry is entitled to engage third parties in the performance of the obligations arising from the Agreement.

3 The way in which delivery will take place and the period within which the products will be delivered is clearly described in good time before the Agreement is concluded. If no delivery period has been agreed or stated, products will in any case be delivered within 14 - 21 days depending on your location.

4 If B's Design Juwelry cannot deliver the products within the agreed term, it will inform the Customer. In that case, the Customer can agree to a new delivery date or he is given the option to dissolve the Agreement free of charge.

5 B's Design Juwelry advises the Customer to inspect the delivered products and to report the defects found within a reasonable time, in writing or by e-mail.

6 As soon as the products to be delivered have been delivered to the specified delivery address, the risk with regard to these products is transferred to the Customer. If expressly agreed otherwise, the risk will pass to the Customer sooner. If the Customer decides to collect the products, the risk is transferred upon transfer of the products.

7 B's Design Juwelry is entitled to deliver a similar product of similar quality to the ordered product, if the ordered product is no longer available. The customer is then entitled to dissolve the agreement free of charge and to return the product free of charge. Unless Customer has agreed to a replacement item.

8 In the event that the order is missing, B's Design Juwelry will ask the customer to sign and return a Recipient's Declaration. The customer does this within the stipulated period by B's Design Juwelry . If the customer does not (timely) cooperate with this, the order will be regarded as received and no refund will be made.

Right of withdrawal

For returns, you should always first contact B's Design Juwelry via the contact form or via info at beesdesign.nl

1 The customer has the right to dissolve the distance agreement with B's Design Juwelry within 14 calendar days after receipt of the product, without stating reasons, free of charge. The period starts on the day after the Customer, or a third party designated by him in advance, who is not the carrier, has received the product, or:

if the Customer has ordered several products in the same order: the day on which the Customer, or a third party designated by him, has received the last product.

if the delivery of a product consists of several shipments or parts: the day on which the Customer, or a third party designated by him, has received the last shipment or the last part;

in the case of agreements for regular delivery of products during a certain period: the day on which the Customer, or a third party designated by him, has received the first product.

The consumer must prove that the delivered goods have been returned on time, for example by means of proof of shipment.

2 The direct costs for the return shipment are for the account of the Customer. The customer must therefore bear the return costs himself. If these costs are higher than the regular postal rate, B's Design Juwelry will provide an estimate of these costs.

3 Within the withdrawal period referred to in paragraph 1, the Customer will handle the product and the packaging with care. The customer will only open the packaging and only use the product to the extent necessary to check the nature, characteristics and functioning of products. The basic principle here is that this inspection may not go beyond what the Customer could do in a physical store. B's Design Juwelry will not refund any traces of use or opened packaging, which is not necessary for inspection. Goods that fall under the Cosmetics Act and the Food and Commodities Act (aromatherapy, care products) cannot be returned.

4 Customer is only liable for depreciation of the product that is the result of a way of handling the product that goes beyond what is allowed in the previous paragraph.

5 The Customer can dissolve the Agreement in accordance with paragraph 1 of the term set in this Article by unambiguously informing B's Design Juwelry that he renounces the purchase. In the event of a digital notification, B's Design Juwelry will confirm receipt of that notification. After termination, the Customer has 14 days to return the product. It is also possible to return the product immediately within the reflection period specified in paragraph 1 of this Article. An unambiguous statement for withdrawal is enclosed.

Products that are made on request cannot be returned and are therefore excluded from the right of withdrawal. Unless this has been agreed in advance or the product is common in the range.

Products can be returned to the address specified in the invoice.

6 Amounts already paid (in advance) by the Customer will be refunded to the Customer as soon as possible, but no later than 14 days after dissolution of the Agreement, in the same way that the Customer paid for the order. If the Customer has chosen a more expensive method of delivery than the cheapest standard delivery, B's Design Juwelry does not have to reimburse the additional costs for the more expensive method

Unless B's Design Juwelry offers to collect the product itself, B's Design Juwelry may withhold payment until B's Design Juwelry has received the product or until the Customer demonstrates that he has returned the product, whichever is the earlier.

7 Information about whether or not the right of withdrawal is applicable and any desired procedure is clearly stated on the Website in good time before the Agreement is concluded.

Payment

1 Customer must make payments to B's Design Juwelry according to the payment methods indicated in the order procedure and possibly on the Website. B's Design Juwelry is free to choose payment methods and they may change from time to time. In the event of payment after delivery, the Customer has a payment term of 14 days starting on the day after delivery.

Warranty and Conformity

1 B's Design Juwelry guarantees that the products comply with the Agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and the legal provisions and/or government regulations existing on the date of the conclusion of the agreement. . If specifically agreed, B's Design Juwelry also guarantees that the product is suitable for other than normal use.

2 A guarantee provided by B's Design Juwelry, manufacturer or importer does not affect the legal rights and claims that the Customer already has and can invoke under the Agreement.

3 If the delivered product does not comply with the Agreement, the Customer must inform B's Design Juwelry thereof within a reasonable period of time after discovering the defect.

4 If B's Design Juwelry considers the complaint to be well-founded, the relevant products will be repaired, replaced or reimbursed after consultation with the Customer. The maximum compensation is equal to the price paid by the Customer for the product. This Article does not preclude an appeal to any compensation.

Complaints procedure

The entrepreneur has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.

Complaints about the implementation of the agreement must be submitted fully and clearly described to the entrepreneur within 7 days, after the consumer has discovered the defects.

Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will answer within the period of 14 days with a notification of receipt and an indication when the consumer can expect a more detailed answer.

If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.

In the event of complaints, a consumer must first turn to the entrepreneur. If the web store is affiliated with Stichting WebwinkelKeur, and in the event of complaints that cannot be resolved by mutual agreement, the consumer should contact Stichting WebwinkelKeur (www.webwinkelkeur.nl), which will mediate free of charge. If a solution is not yet reached, the consumer has the option of having his complaint handled by the independent disputes committee appointed by Stichting WebwinkelKeur, the decision of which is binding and both the entrepreneur and the consumer agree to this binding decision. There are costs associated with submitting a dispute to this disputes committee, which must be paid by the consumer to the relevant committee. It is also possible to register complaints via the European ODR platform (http://ec.europa.eu/odr).

A complaint does not suspend the entrepreneur's obligations, unless the entrepreneur indicates otherwise in writing.

If a complaint is found to be well-founded by the entrepreneur, the entrepreneur will, at its discretion, replace or repair the delivered products free of charge. 

Personal data

1 B's Design Juwelry processes the customer's personal data in accordance with the General Data Protection Regulation (GDPR).

Final Provisions

1 The Agreement is governed by Dutch law.

2 Insofar as not dictated otherwise by mandatory law, all disputes that may arise as a result of the Agreement will be submitted to the competent Dutch court in the district where B's Design Juwelry is located.

3 If a provision in these General Terms and Conditions proves to be invalid, this does not affect the validity of the entire General Terms and Conditions. In that case, the parties will determine (a) new provision(s) as a replacement, which will give shape to the intention of the original provision as much as legally possible.

4 In these General Terms and Conditions, “in writing” also includes communication by e-mail and fax, provided that the identity of the sender and the integrity of the e-mail are sufficiently established.
